Drink Driving Lawyers Sydney

There are 5 categories of drink driving, they are:

  1. Novice Range- Applies if you are a learner or provisional licence holder and are caught driving a motor vehicle on a public road with a blood alcohol level between 0.00 and 0.02. Upon conviction the following penalties apply:
    1. For a first offence:
      A fine up to $1,100.00 An automatic disqualification period of 6 months and a minimum period of 3 months.
    2. For a second or subsequent offence within the last 5 years:
      A fine up to $2,200.00 An automatic disqualification period of 12 months and a minimum period of 6 months.
  2. Special Range- Applies if you are a special category driver and are caught driving a motor vehicle on a public road with a blood alcohol level between 0.02 and 0.05. Upon conviction the following penalties apply:
    1. For a first offence:
      A fine up to $1,100.00
      An automatic disqualification period of 6 months and a minimum period of 3 months.
    2. For a second or subsequent offence within the last 5 years:
      A fine up to $2,200.00
      An automatic disqualification period of 12 months and a minimum period of 6 months.
  3. Low Range- Applies if you drive a motor vehicle and are caught driving on a public road with a blood alcohol level of between 0.05 and 0.08. Upon conviction the following penalties apply:
    1. For a first offence:
      A fine up to $1,100.00
      An automatic disqualification period of 6 months and a minimum period of 3 months.
    2. For a second or subsequent offence within the last 5 years:
      A fine up to $2,200.00
      An automatic disqualification period of 12 months and a minimum period of 6 months.
  4. 1.Mid Range- Applies if you drive a motor vehicle and are caught driving on a public road with blood alcohol level of between 0.08 and 0.15. Upon conviction the following penalties apply:
    1. For a first offence:
      A fine up to $2,200.00, or imprisonment for 9 months, or both. An automatic disqualification period of 12 months and a minimum period of 6 months.
    2. For a second offence within the last 5 years:
      A fine up to $3,300.00, or 12 months imprisonment, or both. An automatic disqualification period of 3 years and a minimum period of 12 months
  5. 1.High Range- Applies if you drive a motor vehicle and are caught driving on a public road with a blood alcohol level of above 0.15. Upon conviction the following penalties apply:
    1. For a first offence:
      A fine up to $3,300.00, or 18 months imprisonment, or both. An automatic disqualification period of 3 years and a minimum period of 12 months.
    2. For a second or subsequent offence within the last 5 years:
      A fine up to $5,500.00, or 2 years imprisonment, or both. An automatic disqualification period of 5 years and a minimum period of 2 years.
  6. Refuse Breath Analysis- Applies if you refuse or fail to provide a sufficient sample for breath analysis. Upon conviction the following penalties apply:
    1. For a first offence:
      A fine of up to $3,300.00 or 18 months imprisonment, or both.
    2. For a second offence within the last 5 years:
      A fine of up to $5,500.00 or 2 years imprisonment, or both.
