The court will grant a divorce once it finds that an irretrievable breakdown of marriage has been established following a period of separation of 12 months. However, you may still live under the same roof and be separated for 12 months. There is a limitation period of 1 year for you to commence proceedings against your former partner in either the Family Court of Australia or the Federal Magistrates Court.
